Since June 15, 2023 it has covered any occupation except primary agriculture in TEER 4 and 5, and the language bar is intermediate French in speaking and listening only. IRCC lists the stream as open; the worker&#8217;s processing fee is $155.<\/p>\n<p>The stream sits in the International Mobility Program under LMIA exemption code C16, &#8220;Mobilit\u00e9 Francophone&#8221;, and permits are issued under subparagraph R205(c)(ii) of the Immigration and Refugee Protection Regulations. Its stated purpose is to promote French in Francophone minority communities outside Quebec. The job itself does not have to be in French.<\/p>\n<h2>Who qualifies<\/h2>\n<p>The rules changed on June 15, 2023. You must also meet the employment requirements listed for the occupation in the National Occupational Classification. The rules that apply to every work permit are on our <a href=\"https:\/\/avalvisa.com\/en\/canada-work-permit\/\">Canada work permit<\/a> page.<\/p>\n<h2>What the employer must do<\/h2>\n<p>You cannot file until your employer has done three things:<\/p>\n<ol>\n<li>submitted the offer of employment to IRCC through the Employer Portal under LMIA exemption code C16, Mobilit\u00e9 Francophone<\/li>\n<li>paid the $230 employer compliance fee<\/li>\n<li>given you the offer of employment number, the 7-digit number your application requires<\/li>\n<\/ol>\n<p>Form IMM 5802 is accepted in place of a Portal number only where IRCC&#8217;s Client Experience Branch has authorized the employer to use it.<\/p>\n<p>Officers then test whether the offer is genuine: is the occupation a reasonable need for this employer, does the wage meet the provincial or territorial minimum and is it reasonable for the position, can the employer afford it on reported income, and do the duties match the occupation and the exemption. Under program integrity they may also look at whether the employer has recently hired many workers from the same region for the same position, and whether its contact details match the company name. You do not have to prove reading or writing for this exemption. The instruction lists what officers accept, &#8220;but not limited to&#8221;:<\/p>\n<ul>\n<li>speaking and listening results from the Test d&#8217;\u00e9valuation de fran\u00e7ais (TEF) or the Test de connaissance du fran\u00e7ais (TCF)<\/li>\n<li>written confirmation from a college or university of a program completed in French, such as an official letter of completion or a transcript<\/li>\n<li>other documents that show education in French<\/li>\n<\/ul>\n<p>Upload the proof in the Client information field. There is only one, so combine several documents into a single file.<\/p>\n<p>Officers have discretion here. If the file does not satisfy them, they can ask for more, for example satisfactory TEF or TCF results or an oral assessment. Test results filed up front avoid that second request; education documents alone leave the call to the officer.<\/p>\n<p>At renewal the instruction is explicit: the language determination was made on the initial application, so no new test result is needed unless the processing officer has concerns. Everything else is assessed again.<\/p>\n<p><strong>This is not the Express Entry French-language category.<\/strong> That category, under <a href=\"https:\/\/avalvisa.com\/en\/canada-express-entry\/\">Express Entry<\/a>, is a route to permanent residence with its own, different language requirements. Meeting NCLC 5 in two skills for C16 tells you nothing about whether you qualify there.<\/p>\n<h2>Fees, validity and after approval<\/h2>\n<p>The worker pays the $155 work permit processing fee online by credit, prepaid or debit card, and the card does not have to be in your name. If you pay with a prepaid card, IRCC advises keeping it for at least 18 months after paying to make any refund easier.<\/p>\n<p>The permit may be issued for the length of the offer of employment or until your travel document expires, whichever comes first. Check your passport expiry before you apply.<\/p>\n<p>IRCC first checks the application for completeness, biometrics included, and returns incomplete files without processing them. What arrives after approval depends on where you applied from:<\/p>\n<ul>\n<li><strong>Outside Canada:<\/strong> a port of entry letter of introduction. This is not the work permit. You present it, with your other documents, at the port of entry, and the permit is issued there on the day you arrive.<\/li>\n<li><strong>Inside Canada:<\/strong> a notification in your online account that the permit is approved. You can start work as soon as you receive it, without waiting for the permit to arrive by mail.<\/li>\n<\/ul>\n<p>Your spouse or common-law partner and your dependent children may be able to apply for an open work permit; the instruction points family members to the open work permit stream under R205(c)(ii). Dependent children can attend school or university, subject to the study permit rules. If you intend to stay, IRCC&#8217;s advice is to apply for permanent residence as soon as you meet the criteria; start with our overview of <a href=\"https:\/\/avalvisa.com\/en\/immigration-to-canada\/\">immigration to Canada<\/a>.<\/p>\n<h2>Three common pitfalls<\/h2>\n<ul>\n<li><strong>Telework for a Quebec employer.<\/strong> Remote work for an employer located in Quebec is not eligible, and you must prove that the work location is outside Quebec.<\/li>\n<li><strong>Primary agriculture in TEER 4 and 5.<\/strong> These are the only excluded occupations, and no level of French brings them back in.<\/li>\n<li><strong>Quebec itself.<\/strong> A job in Quebec is not covered by C16; the program exists for Francophone minority communities outside it.<\/li>\n<\/ul>\n<h2>What to do now<\/h2>\n<ol>\n<li>Confirm the job is physically outside Quebec and is not a primary agriculture role in TEER 4 or 5.<\/li>\n<li>Gather your French evidence: TEF or TCF speaking and listening results, or proof of a program completed in French.<\/li>\n<li>Have the employer file the offer in the Employer Portal under code C16, pay the $230 fee and send you the 7-digit number.<\/li>\n<li>Check that your passport runs at least as long as the offer.<\/li>\n<li>Apply online. From outside Canada, answer Yes to having an offer of employment number and choose the work permit with an LMIA exemption; from inside Canada, answer Yes to having a written job offer and choose the employer-specific work permit with LMIA exemption. Upload the French proof in the Client information field.<\/li>\n<\/ol>\n<h2>Frequently asked questions<\/h2>\n<h3>Does the job have to be in French?<\/h3>\n<p>No. The instruction says the language of work does not need to be French.<\/p>\n<h3>Do I need a French test?<\/h3>\n<p>Not necessarily. Proof of a program completed in French is listed as acceptable, but an officer who is not satisfied may ask for TEF or TCF results or an oral assessment.<\/p>\n<h3>Can a TEER 4 or 5 job qualify?<\/h3>\n<p>Yes, for applications on or after June 15, 2023, in any occupation except primary agriculture under TEER 4 and 5.<\/p>\n<h3>Do I have to retest when I renew?<\/h3>\n<p>No, unless the officer has concerns; the language determination from the initial application carries forward. Everything else is reassessed.<\/p>\n<h3>Can my family come?<\/h3>\n<p>They may be able to apply for an open work permit, and dependent children can go to school or university.
